Contractual Employment Has No vested right to Continue
The Hon,ble High Court of Jammu And Kashmir rejected the contractual employees plea and held that contractual employment has no right to continue and it is not open for the courts to direct an employee to continue the contract or change the status of contractual employment.
The Hon,ble Justice M A Chowdhary while dismissing a petition of 116 candidates who had sought the courts intervention to allow them to complete 3 years service to run 500 bedded temporary Covid Hospitals in Jammu and Kashmir Ut.
The petitioners said before the court they were appointed on contractual basis for one year in tenure based posts of physician, Anesthetists, Pediatricians Medical Officer Etc. The petitioners held that they were engaged in terms of respective engagement orders. The petitioners had also sought directions from the court to release Ayushman incentives as well as covid incentives. Finally court directed to the respondents to release Ayushman incentives as well as covid incentives to the petitioners in terms of notification No. 1 HME of 2019 . The Court Also directed to the respondents they could consider incorporating the condition in the future advertisement Notice.
