CAT Bench Directed Govt To Implement Court Orders
The jammu and kashmir hon, ble cat Bench Srinagar passed an order and directed to the government to implement court orders. The petition titled B. K Toshkhani vs Dr Abishek was listed for hearing on 27th September The Hon,ble CAT held that authority is bound to implement court orders and carrying out the Diginity of law and not evading court orders.
The Tribunal is to seek compliance of its orders and judgement in letter and sprit as already held that concept of law is minimize pain and maximize pleasure. The tribunal further mentioned that court is not feeling happy by calling senior officers or any other before this tribunal. They are to attend to the public grievances and come to their aid by disposing of their concerns expeditiously.
Besides court said tribunal is not weak or powerless can seek compliance of its judgment and orders in terms of prescribed procedure which may even entail ordering warrants bailable or non bailable warrants. The court said senior officers deserves respect but at the same time court cannot lose sight of the fact that a person who approaches to the court.
In view of the matters respondants were directed to comply with the directions passed by the court in letter and sprit.
