Hon,ble Supreme Court Of India,Directions To J&k Higher Education department Contractual employee cannot be replaced by another contractual employee
The Jammu And Kashmir college contractual teachers who served the higher education department from Many years and had obtained status quo by the Hon,ble Court of jammu & kashmir and Now still cases are pending before the CAT Benchs of Union Territory of Jammu and Kashmir got massive relief from the Hon,ble supreme Court of India, Apropos of Continuation of their Services.

The Supreme Of india passed a verdict under the civil appeal No. 103 Of 2021 Mentions that Adhoc/ Contractual employees cannot be replaced by another similar nature candidates. Similarly The Interim order that was passed by the Jammu & Kashmir Tribunal Benches The contractual employee cannot be replaced by the another contractual employee. In This Regard the civil appeal which was filled by the higher education Department Titled Talat Parvez Rohella and Ors. Under Category 1705 Contempt of Court Matter. Appeals u/s 19(1)b of Contempt Of Court Act 1971.
The Hon,ble Supreme Court Of India Disposed off the Case on 02-05-2022 With the Final directions to both Tribunals.Including Jammu CAT Bench And Srinagar CAT Bench To decide the original Application within the Period of Three Months.
Besides In the meantime All the college contractuals who has been granted the benefit of Status quo shall continue their services. And They shall not be replaced by another contractual employee of similar Nature. Read original order passed by the supreme of India.
